THE ISSUE OF SOCIAL DETERMINATION OF RIGHT IN B.N. CHICHERIN’S CONCEPT
Abstract
Social determination of right is examined as an interaction in public conscience of two val- ues: «general weal» and social benefit. General weal is universalizable regulator (mandatory for every reasonable man); public good (social benefit) is a social convention that is formed as a resultant of current citizenry interests and is varied together with them. Both regulators act composed of public law as the most powerful juridical leverage on society. B.N. Chicherin’s assessment of the social benefit as the regulator of public law is dual. On the one hand, it hinders the realization of justice, on the other hand – guarantees the public law efficiency in crisis social situations. Social determination of right is multidimensional and provides various outlook for the public society sector.
